As there is a list of allowed people to drive with a Restricted Driver if the passenger is a parent who is "over the limit", what happens to the driver and the passenger?

Why is there a list of people who can drive with the Restricted Driver? Surely it defeats the purpose of having a Supervised driver

I presume by saying "over the limit" you are referring to alcohol.
If the person in charge of the vehicle is intoxicated they could be charged with a drink driving offence.
If the person driving on a Restricted Licence is driving outside of the conditions of their licence (ie; must have an authorised licensed supervisor if driving between 10pm and 5am and not allowed to carry passengers), they can also be charged.
If I have correctly understood your question, if a restricted driver is driving between the hours of 10pm and 5am with an intoxicated "supervisor", both parties are really committing an offence, as the supervisor is not allowed to supervise, therefore, the restricted driver is carrying a passenger and driving unsupervised.
