A few weeks ago our car broke down. It was towed by AA to a local Mechanics. The mechanic advised us that x parts needed replacing. The total cost was a little under $500. It took us a couple of weeks to save up the money and the car remained at the garage in the meantime (fair enough). When I went back to the garage to pay and collect my car, there was a scratch on the front passenger side wheel hub with traces of paint exactly the same shade of blue as the mechanics hoist. The mechanic denied liability. I drove away and a couple of KM down the road the car broke down again in exactly the same way as originally. So clearly the car was not fixed. The car is now back at the mechanics and another $100 later (last night he told me he needed to do more work to fix the issue) the car is STILL not working and he wants to change the oil pump. Now he is telling me he is not sure if this will even fix the problem.

My question is, given that the mechanic has changed parts that did not need changing (and scratched my car!) should he be refunding me for the unnecessary work? At no time was the work supposed to be diagnostic, he told me it was going to fix the issue, and later told me it was fixed.
