Hi, I purchased a car from a dealer who said there is no guarantee on the vehicle because it is 20 years old. 5 days later it doesn't start. Am I now 24k down the river without a paddle? Thanks

Hi there,
Any purchase from a dealer is covered by the CGA (consumer guarantees act) the dealer can't contract out of this and is not limited by the age of the vehicle sold.
It states that the vehicle must meet requirements of acceptable quality. Price paid, age and vehicle condition are factors of cover but so is the time since purchase that the vehicle has faulted.
Information can be obtained on this link: https://www.consumerprotection.govt.nz/consumer-law-and-your-rights/consumer-guarantees-act/consumer-guarantees-for-products/

Thanks for the advice here.
I see I've signed a sale agreement that says the "there is no form of warrantee on this vehicle as it is over 20 years old. The buyer is aware and agreed with this condition". The vehicle itself is 26 years old and I've signed off on this. Does this mean I'm stuffed in this respect?

Hi there,
Warranty and CGA are two separate subjects. Warranty means the dealer will fix any problems within a specified time period. The CGA is law that governs the sale of goods by a trader and lists conditions required under that sale. One of which states that the goods or vehicle must be durable, 5-days is not durable. The dealer can contract out of a warranty but not the CGA. If you have no luck with the dealer, you may need to seek help from citizens advice or a tribunal, for a remedy.
