I bought Holden cruze 2012 diesel in January 2020. Few days back from car dealer. When i bought AC was not blowing cold air and car dealer refill gas in it and the gas went away in 3 days because of leak. When i spoke to dealer he said AC not covered in warranty when i told him that this is existing issue i told you earlier at buying time that there must be leaking somewhere. Now I diagnosed it at my cost and found compressors leaking , switch and filter and oil need to replace which will cost me $1550 now dealer is agreed to send me aftermarket parts and i will pay laubour charges which is nearly $700 so My question is if I put aftermarket parts and if same issue will appear after some time than the car dealer will be responsible for it again or not and can i refuse to pay labour charges because it was existing issue he knew it

Hello I have attached this section from the CGA,

The CGA guarantees mean the vehicle should be:
•of acceptable quality – reasonable in look and finish, durable and safe
•fit for purpose – either generally or to meet a specific purpose you told the dealer before you bought the vehicle
•as described – match the description in advertising or anything the dealer said at the time.

Aftermarket parts shouldn't be any worse than the original parts providing they are of decent quality, as this fault appears to have occurred so soon after purchase I would dispute paying for the labour.

If the vehicle was described as having AC it should be fitted and functional.
