Hi,
My daughter (Fully licensed) recently had a carpark incident with my car and the other people's insurance company (AMI) phoned her for her side (Which she provided) and they now have sent a statement form for her to fill in. We are insured with AA but with her $1000 excess we are just going to fix our car. The other people have claimed for their very minor (less than our) damage. My daughter reversed out of her park after a car had gone past, but they saw another free park and reversed (without looking) into her. Even though she had backed out, stopped and moved into drive I suspect a disputes tribunal referee is going to say they were both reversing so split liability and I'm OK with that but I don't want AMI going us for costs just because we haven't claimed. Daughter had a passenger/witness but there were two in their car as well. Other party apologized at the time but of course are now saying she backed into them.
Should we fill in the form so they have the full story or will they just use it against us somehow?

Hi there,
As you are aware there are always two sides and it looks like this situation could reach a stalemate very easily. The 50/50 split liability is often reached between two insurance parties making opposing claims, and you're right in the absence of a counter claim could be seen as accepting liability.
Outside making a claim, there's a few options, give a statement and hope for the best. Or if you do get sent a bill, you could make a dispute tribunal claim for the costs of repairs to your vehicle which could still be cheaper than claiming insurance?

I think you should google the car park and look for things like entry only signage and directional arrows, I would include a satellite view of the car park as well and mark the positions of the vehicles when the collision occurred (screenshots), I personally found referees at the Disputes Tribunal's are very fair and helpful in resolving disputes,

Cheers for the good advice. Talked to AA Insurance as well and they also said provide the statement and they took a report. If AMI give us any grief then AA Ins will open a claim and represent us even if we aren't claiming actual repair, pretty good I thought. Will resort to the disputes tribunal only as a last resort and only if AA couldn't sort it out.
