Hi, I paid a $5,000 deposit at Hyundai dealership for a Hyundai Kona electric vehicle on 2 October. Hyundai have since recalled this vehicle (globally) due to fire risk (unexplained fires in 13 vehicles). Meanwhile the dealership are unable to sell it to me until its 'fixed'. However it appears it is not clear what the issue is caused by so I no longer have the confidence that the proposed 'fix' will reduce the fire risk. I did not sign any contract or agreement, no written term and conditions were given. I no longer have confidence in this vehicle. Am I entitled to a refund of my deposit (since unable to guarantee now 'safe' and I don't want to wait however many more weeks without a vehicle)?

Hi there,
The Consumer Guarantees Act (CGA) doesn't give information on the rights to obtain a refund in the event of a sale cancellation. However it would be up to the selling dealer as to if they see a reasonable reason to return the money.
