Hi there

I was filling up with petrol at a service station. The pump I was at was on the right hand side, and there are another pump on left of me which no one was at. Checked my mirrors and went to move forward (barely taking my foot off the break) when a car hit me at speed from the left. That car had come in off a main road (80km) and was heading to the station shop. The damage is to the front left of my car and the drivers door of the other driver - she is saying this is my fault. How can that be when I was virtually stationary, my mirrors were clear when I checked and she was speeding through between two pumps to get to the service station shop. I don't think I am at fault at all.

Hi there,
Unfortunately it does appear you may be in the wrong, by the fact that the damage was the LH front corner of your vehicle and the door of the other. This would indicate that half of the other car had passed by before impacting the corner of your vehicle. If you were pulling out of one lane and manoeuvring into the next (changing direction), you must take all consideration of the traffic around. This is the view that law enforcement officers would take. I have experienced a similar situation and was found to be in the wrong.
