last year i had an accident up in auckland we have all our insurances through bank re loan we had written off one car in head one 4 weeks before i got a new car and was on phone to tower over the wreak and told them have new car gave details no one got back to me then i was up in auckland a young man came up inside lane at lights doing at least 50 k i tried to pull over into inside lane from way back he was blasting me with his horn i had cars going around the outside of me he clipped back left mudgard when i phoned tower was told they got back to me to go to our bank to do new car so i was not insured when we got to small claims state claimed they had recording of me admitting all liability i have copy of one conversation given over by them since accident in which i totally denie liability they told small claim i admitted complette fault so i lost and am paying off $800 something bill regards mike service

I have tried to decipher what happened...

Last year I had an accident in Auckland, the vehicles are insured and our loans were also secured through the Bank, we have had one vehicle written off due to a collision and this vehicle has been replaced, I rang Tower Insurance about the written off vehicle, at the same time I advised Tower by phone that I now had a replacement vehicle and gave them the details, I was again in Auckland when a vehicle driven by a young man who was in the inside lane, I was attempting to change lanes when I noticed a vehicle approaching sounding his horn, as I attempted a make a lane change I had other vehicles passing me on the outside lane, the young man's vehicle clipped my rear guard, I contacted Tower about my telephone conversation they said to take up the matter with the bank as I did not have insurance cover,

Conclusion: State Insurance applied to the small claims court and the adjudicator found I was at fault, the adjudicator was told by State that I had admitted liability, the adjudicator found in State Insurances favour and awarded them $800 dollars, I still deny liability for the accident, (Mike Service).

I think the issue here is the driver of the damaged vehicle thought he was covered by the insurer, I am aware State and others record phone calls.

I also think the driver of the damaged vehicle does not think he was liable for the accident when he made a lane change

Maybe, but we never like to assume.
However, assuming you are correct, the matter of who was at fault seems to have been determined at the Disputes Tribunal. Again, we don't like to assume, but generally speaking, the vehicle changing lanes is at fault, so we would agree with their finding.
Therefore, the real issue here is whether cover existed. As you say, insurance companies record calls to avoid any confusion at a later date, so michaeljo can request the insurer to extract the conversation and determine whether or not a conversation took place regarding cover. All it takes is notifying them which number you called from, and in this case it would be easy, as would appear that a conversation took place, only the content of the call is in question.
