Hi there, my friend was recently in an automobile accident, he was riding his motorbike along the road when a car pulled out in front of him causing him to crash into the side of the aforementioned car. It seems straight forward that the car was in the wrong, however i was told that the friend was possibly fleeing from the police to avoid a ticket. While I am angry and disappointed at his behaviour i was wondering about the liability for the accident. If he was travelling in excess of the speed limit which seems more than likely, is the person in the car still at fault? This was at night but his head light on his bike was working and on at the time.

Clearly, this is a situation that will be fully investigated, and without knowing all the facts, we're merely speculating.
If your friend was fleeing from the police at 50km/h when someone pulled out in front of him, then it's likely to be deemed the other driver's fault. But I've never heard of someone fleeing from the police at 50km/h!
The most likely senario, is that the motorcycle was travelling at excessive speed, so would be deemed to be in the wrong.

Thank you for the reply, was just trying to get it clear in my head, and as you said it would have to go by thefacts of which i have very little knowledge of, just heresay.
