Can you define a cycle lane. The area Im referring to was like a larger parking lane with cars parallel parked and then the one lane line defining the start of the road, it varied in width from nothing at the start to near two feet at the widest part. At no point was there two lines, any green marking or cycle signs on road or on side of road or footpath. It was on a SH in a very busy part of town. There are several business entrances and I was signalling and turning into one of these, with another car behind doing the same thing when a cyclist came up at speed passing him on the left and clipping the rear of my car as I had left the road and was almost in the entrance. I had looked but didn't see him and didn't pass him to my knowledge, the distance was pretty short from the intersection, we had approached from opposite directions. While I did look to see it was clear I didn't think a cyclist in particular would be there as I didn't think it was a cycle lane. There were large cars parked on the zone but I understand the cyclist kept to the area between the parked cars and the edge line of the road. This one line did go across the entrance ways. The police said it was a cycle lane and I am being charged but I just wish it was better defined as this area is so busy with huge trucks parking up, some to get lunch from KFC or unload and large cars and the danger to cyclists must be huge. I didn't think I was a bad driver but accidents happen and its a shame when the road conditions don't help.

Can you let us know the street name and city so we can check the road markings on Google maps. You can either reply to this post or email aatech@aa.co.nz. If at all possible, email us a photo of the road markings in case Google maps is not up to date - but only take a photo if its safe to do so.

More generally, even if it wasn't a cycle lane, the cyclist might have been entitled to be there, so you may have decide whether you want to challenge the infringement if you consider you weren't at fault.
