Hi
I was reversing a car out of an angle parking space at a shopping centre after checking it was clear to do so. I was out in the open space when a car on the opposite side to me but 3 spaces behind reversed out of her parking space and hit my rear side corner. Witnesses said to me that the other driver was at fault and gave me their details. The other driver said she didn't see me.
I spoke to my insurance company and they said they don't worry about witnesses in an accident like this as they say the road code specifies that in a reversing situation both drivers are at fault and we will both have to pay the excess and I will lose my no claims status. Both of us are insured with the same insurance company.
This doesn't seem right and fair to me. I have a witness saying the other driver was at fault. Why should I have to pay the excess and lose my no claims bonus / status.

Could you let me know what I should do.

Hi there,
I would have to say this is correct and both reversing drivers are at fault.
The road user rule states that when parking you must do so with due care and reasonable consideration for other users. So this would apply in this case for both drivers.
