Hi There,

I was on my scooter the other day, riding on the bus lane. I was a 4 lane road (2 lanes on the right-oncoming traffic and 2 on the left separated by a a flush median). The left lane close to the kerb is the bus lane. It was 9 o clock in the morning and thus, the normal lane was packed with traffic (that`s is the other reason I opted to commute on the bus lane, and I`m anyway legal to drive on that lane) and there was this lady in her car who pulled through the traffic from the opposite direction, wanting to enter into a drive way. So, obviously she had to cross the bus lane and while doing this, she came and collided with my scooter head on!

I was thrown out on the kerb side and I was lucky enough to escape from fractures or a broken skull. I was taken to the hospital by the ambulance, followed by police investigation and I now have the police report which says it was her fault, as she failed to give way to the ongoing traffic while turning from a flush median. My scooter is now a total loss and her SUV is pretty stable with a couple of cracks on her front bumper!

I wanted to repair my scooter but since the repair quote was more than the price of this scooter, i had to write it off. I was claiming this 3rd party insurance (from the lady`s insurance company, as I don't have one). The insurance company sent pre-accident valuators and they offered me a decent price for my scooter to be written off.

But, I haven`t got my money paid yet since the lady is so adamant to accept that it is her fault! This is very strange, as i always thought that the police report is the final point where everybody come to know who takes the blame and everyone has to agree upon the report.
The insurance company recently updated me that she is still denying and thus I have to go to dispute tribunal to solve this issue!

Could you please advise me, what should I do? Wont the police report be good enough to prove who is at fault? Can someone keep arguing in-spite of the decision made by the police? It kind of annoys me a lot how the judicial system works!
At the end of the day, i lost $4500 towards my scooter and i`m the one who had to undergo whole bunch of pain and agony, both physical and mental after the crash!

Hi Prab,
What an ordeal you have been through. However we all still have the right to protest if we think we are not in the wrong, with this still in play, the insurance company won't pay out.
So a tribunal will be the next best option, if the police report states the lady is in the wrong, then it will be pretty hard to dispute this and you will then have a good chance of winning and the insurance company will then pay out. But also the other party will be able to state their case also, so both sides will be heard. It may take a few more weeks to get the tribunal hearing underway, but hopefully the outcome will be desirable.

Oh Boy!

With that said, tribunal`s judgement is kind of final, is it? She cant deny further, right?
