I bought a 2nd hand 2013 Ford Focus 3 weeks ago. The transmission at low speed was a little bit funny that it trembles a bit when accelerating. So I rang the dealer and they were happy to check it and they use the term 'shuddering'. Upon checking, they said the 'shuddering' was out of the range so they did some software update and tuning to bring it 'within specs'. The car still shudders at low speed but it is not as bad as before. I suspected the dealer knows the 'shuddering' is a widely known issue because he uses the term straight away.

I then google the issue online and found quite a lot of bad publicity about the transmission shuddering issue and potential court cases in us and Australia. The transmission technology is known as Powershift.

My question is can I return the car on the basis that the car has the 'shuddering' issue, and they have not disclosed the negative publicity and potential court cases?

Hi there,
Under the CGA, rejection of the vehicle is only an option if fault is classed as serious.
A shuddering issue in itself may not be grounds of a serious fault, and if the dealer is willing to assist then they are currently fulfilling their obligations.
