Hi.

What if I was in an accident where I (on a motorcycle) rear ended a car which stopped suddenly on the motorway? The car in front of me had to brake suddenly to avoid a car which stopped suddenly IN FRONT of him. I had quite a safe following distance thus was able to avoid a serious crash, and the car in front of me did not sustain any damage at all due to me. However, my motorcycle is damaged at the front end. The driver of the car in front of me offered his insurance for me to fix my bike, as he admitted that it is due to his poor following distance of the car ahead, thus he had to brake suddenly, causing me to rear end him despite my safe following distance.

However, when I submitted my claim to my insurance company, they said that the accident is my fault, and they will not be contacting the other insurance company on my behalf as they are "currently backed up with online claims".

What can I do in this case? I have the name, rego, and contact number of the driver who offered his insurance for claims. thanks.

The driver in front of you had sufficient distance to stop and avoid an accident however you bike did not , therefore your insurance company have decided you are at fault because you vehicle did not have enough distance to stop safely.

The driver that you have crashed into may claimed for damages sustained to their vehicle from your insurance company if you lodge a claim, but us appears thay they have not sustained damage.

Hi Ian, thanks for your reply.
The car in front of me did not have safe following distance and he did crash into the car in front of him, causing damage to another vehicle. I was able to stop safely to the point where the car in front of me did not sustain any damage at all because of me. He acknowledged that it was his fault, and that I had safe following distance from him.

I guess my question now is, if he admits fault, and he is willing to take the hit under his insurance, and both of us agree that I wasn’t at fault, then why is my insurer refusing to help me liaise with the other insurer?
