my wife was recently stung with an infringement for being in a 24 hour special Vehicle Lane in Auckland.
They have refused to waive the fine.
My argument is that the bus lane does not meet the standards for a bus lane.
The Bus Lane DOES meet the 'Traffic Control Devices Rule 2004 S11.2 with 'BUS LANE' and a sign in the appropriate place
It does not however meet Auckland Transports Code of Practice for special vehicle lane road markings. It has no Solid green line adjacent to the solid white line down the length of the lane and it doesn't have a large green box where 'BUS LANE' is written.
I argue the infringement is invalid on the basis the bus lane is not FULLY compliant with both national and local law/bylaw? any help please?
