I had an accident a few weeks ago which resulted in my and the other persons' car being written off! I was at a stop sign junction intending to turn right. I stopped but didn't see a car coming, so I took the turn. The other car going straight across was speeding and I couldn't see it as there is a bend on the road. The other car collided into mine while I was making the turn.

I didn't have insurance at the time while the other person did and they reached out to their insurer who made a claim against me for approximately $4,600 and sent me a bunch of letters which stated their cars' market valuation, repair costs etcetera.

Since I didn't have insurance, I couldn't do the same.

I did not accept any fault and therefore counterclaimed the company for $2000 to which they responded by saying that they will take this to the disputes tribunal for resolution.

There were no witnesses to prove who was at fault. I am on a restricted licence.

Hi there,
In this situation both sides of the story will require representation, however it would be best to speak with a police officer in this situation and outline the events that happened and ask what they would say is the law. The road rules can be found here: https://www.nzta.govt.nz/roadcode/general-road-code/road-code/about-driving/giving-way/the-give-way-rules/

May I know how would it be resolved at the Tribunal? Could it possibly turn into a legal case?
