My partners car has just failed its Warrant of Fitness and we've booked it in to be fixed but the garage is booked out for two weeks in advance. My partner needs the car for work and we don't have any alternative transport.

My question is; if he was pulled over by a police officer can he be fined for not having a current WoF even though he has the warrant check and can explain the vehicle is booked in to be fixed?

If he does get a ticket does he have to pay it or can he go into the police station and show he has a current warrant (when issued) and have the fine waived?

Unfortunately the answer is no. You are not legally allowed to drive a vehicle without a current WoF apart for the express purpose of obtaining a new WoF or driving to a place of repair.

It's always a good idea to get the WoF inspection done a couple of weeks before its due to expire in case of a rejection issue.

The best solution may be to locate another repairer or ask your current garage to give you some priority especially if you have been a loyal customer in the past.
