Can you carry a passenger when riding a 50cc scooter (registered as a moped)?

I have a full drivers licence and have been told Yes & No from LTSA and VTNZ.

The Land Transport Agency factsheet says "yes you can" so long as your Moped has a pillion seat and footrests.

There appear to be no drivers licence restriction on a (genuine) moped, however, if the "moped" is actually a motorcycle incorrectly registered (i.e. capable of speed in excess of 50km per hour etc), then a full motorcycle licence would be required before the rider is allowed to carry a pillion.

I doubt there would be many (any?) mopeds where it would be practical or safe to carry a passenger bearing in mind the power to weight ratio issue you would encounter.
