International Driving Permit - Terms of Sale

 These Terms of Sale are important. Please read them fully before submitting your Application.

Introduction

An IDP is a special driving permit for tourists as:

  • a means of allowing you to drive internationally, without further tests or applications, provided your New Zealand driver’s licence is valid, and
  • proof that you hold a valid New Zealand driver licence at the date of issue of the IDP. 

An IDP is not a stand-alone document or a substitute for a valid driving licence, you must carry your New Zealand driver licence with your IDP at all times. It in no way diminishes your obligations to conform strictly to the laws and regulations of the countries that you visit.

The IDP we issue is under the 1949 United Nations Convention on Road Traffic. This IDP is not accepted in all countries. A list of excluded countries is published on our Website but this can change at short notice. We recommend you contact your destination’s embassy or consulate to confirm you can use an IDP for the purposes you intend.

You are responsible for making your own enquiries about whether this IDP will be accepted in your destination(s) and for the purposes you wish to use it. 

If you apply for an IDP that is not accepted in your destination(s), we are not responsible for any inability to drive, rent a vehicle, obtain insurance, or any fines, costs, or losses you may incur.

Definitions

In these Terms of Sale:

AA means The New Zealand Automobile Association (Incorporated), with New Zealand Business Number 9429042781608. 

Application means the application form (digital / electronic or paper) you complete and lodge with us for the manufacture and/or supply of an IDP. 

Consequential Loss includes all forms of indirect loss including loss of revenue, loss of profits, failure to recognise profits or savings and any other commercial and economic loss, however caused. 

Expected Delivery Date means the expected delivery date stated in the Application, or as we notify you from time to time. 

GST means goods and services tax as defined in the Goods and Services Tax Act 1985. 

IDP means an International Driving Permit. 

IDP Terms of Sale means the terms and conditions set out in this document, as updated from time to time. 

Liability means responsibility for any loss (either direct or indirect), damage, or expense and includes liability for Consequential Loss. 

Personal Information has the meaning given to that term in the Privacy Act 2020.

Purchase Price means the total price (including freight) for the IDP as specified in your Application. 

Related Services means any services performed in supplying an IDP. 

Sales Agent(s) means a third party we authorise to sell or arrange the sale of an IDP, including any AA Driver Licensing Agent. Sales Agents are not our employees.

We (with capitals or not) means the AA and our Sales Agent(s), and the words us and our have corresponding meanings. 

Website means our website page International Driving Permits for driving overseas

You (with capitals or not) means the user of this Website who places an Application with us and the words your and yours have the corresponding meaning. 

1.0 Acceptance of IDP Terms of Sale

1.1 You agree to the IDP Terms of Sale when you submit an Application to purchase an IDP directly with us (via our Website or in-store at an AA        Centre and select AA Auto Centres and AA Vehicle Testing Stations) or through one of our Sales Agents. 

1.2 Each Application you place will be a separate and binding agreement between you and us with respect to the supply of IDPs. 

1.3 If you submit an Application via one of our Sales Agents, you consent and agree to the Sales Agent acting on our behalf to assist in the        performance of the Related Services. 

2.0 Validity

2.1 An IDP is a translation of your New Zealand driver licence. An IDP itself does not grant you the legal right to drive in the country of intended       travel unless the local law provides such a right. 

2.2 IDPs, subject to the laws, rules, regulations and guidelines of the country of intended travel, are valid for 12 months from the issue date unless        your New Zealand driver licence expires, is suspended, or revoked in the meantime. An IDP cannot be used permanently in another country. 

2.3 You are required to carry your New Zealand driver licence with your IDP whilst overseas.

2.4 When travelling overseas, an overseas authority may not consider an IDP to be valid unless you show it together with your New Zealand driver       licence. This means an IDP must be accompanied by your New Zealand driver licence. 

2.5 Some countries of intended travel may require additional steps prior to the IDP being given legal status. Please ensure you are aware of the             relevant obligations related to driving in the country of intended travel.

2.6 We strongly encourage you to contact the country of intended travel’s embassy or consulate to confirm the status of an IDP and to obtain the        requirements of a traveller’s legal right to drive in their country, before you depart New Zealand.

3.0 Application Request

3.1 You must be 18 years of age or older, and have a Full New Zealand driver licence, to place an Application to buy an IDP. A temporary paper       driver licence will not be accepted.

3.2 Neither we nor our Sales Agents are obliged to sell an IDP to any person under the age of 18 or who does not hold a Full New Zealand driver       licence.   

3.3 You may place an Application to buy an IDP by:

(a) submitting the Application form on our Website

(b) completing an Application form in-store at one of our AA Centres and select AA Auto Centres and AA Vehicle Testing Stations, or with a       Sales Agent.  

3.4 When you place an Application, you make an offer to us to buy the IDP and we may accept or reject an Application at our discretion, having        regard to the satisfaction of application requirements for the Application.

3.5 You represent and warrant in our favour that:

(a) the information provided in your Application is: 

(i) your own Personal Information, and  

(ii) correct, accurate and current at the time when you submit the Application for an IDP, 

(b) you are the individual applicant subject of the Application, and you have the necessary capacity to agree to these IDP Terms of Sale and       perform your obligations pursuant to it, and you acknowledge and agree that we are entering into these IDP Terms of Sale and will process       your Application in reliance of these warranties.

3.6 We will:

(a) if your Application is accepted:

(i) notify you that your Application has been submitted, and 

(ii) dispatch or hand to you the IDP, or

(b) if your Application is rejected:

(i) notify you that it is rejected, and

(ii) if you have placed an Application on our Website, refund the Purchase Price to the credit or debit card that you paid with.

      Submitted Photos

3.7 You agree and acknowledge that the photo you submit with your Application needs to meet certain criteria, which is communicated to you        when making an Application. 

3.8 Should your photo not meet this criteria, we may notify you of the deficiencies and seek an alternative photo.

3.9 You may submit the alternate photo via e-mail when an online / digital Application is submitted. E-mail is not always secure. If you choose to e-       mail an alternate photo, we will still take reasonable steps to protect your Personal Information in accordance with the Privacy Act 2020 and              our Privacy Statement.

3.10 We are not responsible for any delay in supplying the IDP caused by the submitted photo not meeting the photo criteria.

4.0 Payment

        4.1 Prices may change from time to time and the price for the IDP will be listed on the Website and conveyed to you at our, and our Sales Agents’,                shopfronts.

        4.2 You must pay us the Purchase Price at the time of your Application. 

        4.3 If you pay by credit or debit card, you warrant that your credit or debit card details are true and correct and that you are authorised to charge                the relevant credit or debit card.

        4.4 All prices are in New Zealand dollars (currency code $NZD) unless otherwise indicated.

5.0 Variation or Cancellation of Applications

      Variation

5.1 You may request to vary your Application and we may accept your request at our reasonable discretion.

5.2 We cannot vary any Application where the IDP has already been dispatched or already provided to you.

5.3 In the event of variation:  

(a) we are not responsible for any delay in supplying the IDP caused by the variation,

(b) nominated service level times, including but not limited to, processing and/or delivery, nominated from time to time may be affected by             the variation and you understand any such timeframe may not apply to a varied Application,

         (c) you will use all reasonable endeavours to provide any requested information within the timeframe mentioned in such notice. If no                              timeframe is nominated, then all information requested must be provided within 3 days of the date of notification,

(d) failing to abide by the clause 5.3(c) to our satisfaction may result in the cancellation of your Application, at your cost, and

(e) we may cease to manufacture and/or supply of the IDP at our reasonable discretion, until any variation request is resolved.

5.4 You acknowledge and agree that we reserve the right to cancel any Application if:

(a) your Application is deficient with regards to the requested criteria, or

(b) we detect inconsistencies or irregularities in your Application which give rise to our reasonable doubt that:

(i) you are not the individual applicant in your Application, or 

(ii) you fail to discharge the requisition under clause 5.3(c) to our satisfaction.

        Change-of-mind Cancellation

        5.5 Once an Application has been submitted, due to fast processing times, we do not offer change of mind cancellations once processing has                           started. This does not affect any rights or remedies you may have under the Consumer Guarantees Act 1993 or Fair Trading Act 1986.

6.0 Accuracy of IDP Description

6.1 You acknowledge and agree that all pictures and images of the IDP possibly displayed on the Website or our / a Sales Agent’s shopfront are for        illustration purposes only and the sizes and dimensions of the IDP may differ from the pictures in the physical format of the IDP; and you have        read and understood all descriptions, purposes and functions about the IDP prior to submitting your Application.

6.2 Whilst we endeavour to ensure the quality of information published on the Website about the IDP, and any printed brochures available in-        store, you acknowledge and agree that any information on the Website / printed collateral about the IDP is general information only and are         subject to technical or administrative errors, including but not limited to the IDPs description, pricing and availability. 

6.3 We may correct any errors on our Website or on a Sales Agents’ shopfront and if you placed an Application for an IDP that had errors, we may        at our discretion:

(a) inform you of the errors for you to re-submit, with regard to clause 5, your Application, or

(b) reject your Application and refund the full amount of payment you made.

7.0 Applications via our Website – Shipping and Delivery

7.1 We will use reasonable endeavours to ensure the IDP is dispatched to you so that you may receive the IDP on or around the Expected Delivery       Date.

8.0 Privacy Statement

8.1 The way in which we collect, securely store, and handle your Personal Information is governed by our Privacy Statement.

9.0 Warranties and Guarantees

9.1 If you are acquiring an IDP for personal use, you have rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. Nothing        in these IDP Terms of Sale limits or excludes those rights. 

10.0 Limitation of Liability

10.1 Nothing in these IDP Terms of Sale will exclude or limit our ability in respect of any:

(a) death or personal injury caused by our negligence,

(b) fraud or fraudulent misrepresentation on the part of us,

(c) matter which it would be illegal or unlawful for us to exclude or limit, or attempt to or purport to exclude or limit, its liability.

10.2 To the fullest extent permitted by law, we are not liable for delays or failures caused by e-mail transmission issues outside our reasonable          control. This does not limit our obligations under the Privacy Act 2020. 

10.3 To the fullest extent permitted by law, we are not liable in any way for Consequential Loss. We will be liable for any Liability you have suffered          as a direct result of our negligence.

10.4 Nothing in this clause limits your rights under the Consumer Guarantees Act 1993 (if you are a consumer). To the fullest extent permitted by          law, our Liability to you for the supply of the IDP is limited to the amount of the Purchase Price you have paid us for the IDP, unless a court          has ordered otherwise. 

10.5 To the fullest extent permitted by law, we are not Liable for any consequences resulting from your provision of false, fraudulent, outdated or          incorrect information to obtain the IDP, including as a result of our cancellation of your Application pursuant to clause 5.5. 

10.6 To the fullest extent permitted by law, our Liability for any breach of any condition, warranty or guarantee is, at our discretion, limited to the          lesser of:

(a) if the breach relates to the IDP:

(i) the replacement of the IDP, or

(ii) the payment of the cost of replacing the IDP, and

(b) if the breach relates to services:

(i) re-supplying services,  

(ii) paying the reasonable costs of re- supplying the services, or

(iii) refunding the portion of the Purchase Price that you have paid.

11.0 Jurisdiction

11.1 This Agreement is governed by the laws of New Zealand.

11.2 We and you irrevocably submit to the exclusive jurisdiction of the courts of New Zealand.

12.0 Severability

12.1 If all, or any part, of any clause of these IDP Terms of Sale is invalid or unenforceable, then:

(a) that clause is severed from these IDP Terms of Sale to the extent necessary to remove the invalidity or illegality, 

(b) the remaining clauses of these IDP Terms of Sale remain valid and enforceable.

13.0 Survival of Specific Clauses

13.1 The clauses in these IDP Terms of Sale which are capable of having effect after the IDP Terms of Sale end continue to have full effect, including         (but not limited to) clauses in relation to guarantees, warranties, and limitation of liability.
