In these Terms and Conditions:
"AA" means The New Zealand Automobile Association Incorporated.
"AA Mobility Care Passenger Programme" means the Services provided under this programme to any Nominated Vehicle that is used to provide mobility assistance services to the Mobility Care cover holder.
"AA Service Provider" means any person or company providing the Services at the request or direction of the AA and any servant or agent of that person or company having that company’s or person’s authority to provide the Services.
“Account” means a record of a relationship between the AA and a client including the provision of regular services, and other financial transactions including vehicle subscriptions.
“Business Information” means the confidential and proprietary listing of any name and address details, or any other details of the Driver and the Business provided by the Business to the AA.
"Card" means the AA Business Care card.
"Customer" means the Business entity listed as a financial customer in whose name the AA account is maintained.
"Driver " means the person in command of the vehicle at the time of the breakdown.
“Metro” is defined by Statistics New Zealand as Whangarei, Auckland, Hamilton, Tauranga, Rotorua, Gisborne, Napier-Hastings, New Plymouth, Whanganui, Palmerston North, Kapiti, Wellington, Nelson, Christchurch, Dunedin and Invercargill.
“Nominated Vehicle” means a motorised vehicle nominated to have access to the Services specified and which at the time of breakdown. For clarity, this includes motorised wheelchairs and mobility scooters.
“Non-mechanical breakdown” means a breakdown that indirectly relates to the vehicle, and can often be attributed to action taken by the Driver of the vehicle (e.g. lost keys, lights left on, etc.).
"Programme" means the Business Care Programme for the duration of the paid AA subscription.
“Programme Year” means the 12 month period covered by the customer’s subscription.
“Services” means the services applicable to each of the Nominated Vehicles under the relevant account package.
“Subscription” means the fee specified for each Nominated Vehicle; the AA reserves the right to review and change subscription rates at the time of renewal in relation to the AA Roadservice usage.
“Subscription period” means the 12-month cover provided to the Nominated Vehicle which is not refundable.
In these terms and conditions, singular includes plurals and vice versa and references to a gender shall include all genders.
References to natural persons include bodies corporate and vice versa.
All dollar figures include GST.
Each 12-month Mobility Care policy comes with unlimited service callouts, and service coverage is on any public road within the North and South Islands of New Zealand. In all cases, the method and extent of the Service provided will rest with the AA Service Provider.
The AA Service Provider will endeavour to make the Nominated Mobility Scooter mobile at the roadside so that the driver can continue their journey. However, where this is not possible or practical, or where any mechanical action may void any part of the Nominated Mobility Scooter’s warranty, vehicle recovery will be provided.
Where the AA does not have an account with the taxi company, the driver may need to pay and send the receipt to the AA for reimbursement.
The AA will provide service to nominated Mobility Scooters as follows:
Service will only be provided to Nominated Mobility Scooters disabled on constructed roads/driveways that are legally and safely trafficable by conventional two-wheel drive vehicles and/ or the towing/ recovery vehicle (where required) as determined by the AA Service Provider. Service will be provided to Nominated Mobility Scooters stranded on a public road provided no special equipment (such as power winches, extended cables, etc) are required.
Where the Nominated Mobility Scooter becomes disabled off a legally designated/formed public road (such as a beach, field or creek bed), rescue of the Mobility Scooter may be arranged at the discretion of the AA Service Provider, and at the driver’s expense.
Should special equipment be necessary to effectively deliver service and/or where the AA Service Provider has to return to their facility to obtain and special equipment, the additional cost involved will be charged to and paid by the driver.
The AA reserves the right to alter and/or offer alternative assistance where a natural disaster places extraordinary demands on the provisions of service. Where a disabled Nominated Mobility Scooter cannot be reached, (e.g. due to floods, slips, fire, etc), the AA Service Provider will attempt to provide whatever alternative assistance is practical under the circumstances. Any such assistance will be at the discretion of the AA and will not be unreasonably withheld. The AA will provide assistance on a best endeavours basis and offer to contact a towing contractor to attend the Mobility Scooter.
Where the Nominated Mobility Scooter is found unattended, the roadside assistance job will be abandoned, and your company will be informed of the incident accordingly. Any subsequent calls for service (deemed by the AA Service Provider to be for the same incident) will be at the driver’s expense.
Where the AA Service Provider attends a roadside assistance call and, after initial inspection, reasonably considers a prior attempt to repair the Nominated Mobility Scooter has caused subsequent damage (and the Nominated Mobility Scooter cannot be started or driven without risk of further damage), the AA Service Provider will communicate with an AA service representative to ensure that the Mobility Scooter warranty has not been compromised before any further service is offered.
Should the AA service representative recommend that service is no longer valid under the mechanical warranty; any cost of service under this circumstance would be at the driver’s expense and without any liability on the part of the AA.
Where service is requested for a Mobility Scooter deemed to be covered under the Mobility Care programme (on producing a policy number/information) but that is not listed on the AA database, the AA will provide service as authorised in the agreement. The AA will inform your company the next working day of any registration numbers not listed.
Where Service is requested for a vehicle that is found not to be nominated after 30 days from the date of purchase of warranty, the AA may charge a fee in extreme circumstances where third party costs are involved.
Exclusions are:
Any mechanical fault or breakdown that occurred before, or within 24 hours of, purchasing AA Business Care Programme.
When the vehicle is disabled or damaged due to a motor vehicle accident, or stolen, or damaged due to theft or vandalism.
When the vehicle is unattended at the time the AA Service Provider arrives at the breakdown location.
Subscriptions that are still unpaid when AA Roadservice is required
The AA Badge and Branding must not be used on any information or documentation without gaining prior written permission from the AA for every instance where use of the AA name or Badge is requested. Participation in the AA Rental Care Programme does not give any organisation right to the use of the AA Badge or name. Any unauthorised use of the AA Brand must be removed from all communications or vehicles unless prior written approval has been obtained.
Where a Nominated Vehicle has been sold within the subscription period of that vehicle, the Business shall be allowed to replace it for the remainder of the subscription period with a vehicle within the same programme provided the Nominated Vehicle had no callouts in that subscription period.
The AA reserves the right to terminate your Programme by giving the seven days written notice if the AA deems that the Programme has been abused or the Terms and Conditions of this Programme have been breached.
The AA endeavours to ensure all sub-contracted providers are registered with their appropriate trade or professional body and have the necessary qualifications to provide products or services to a standard acceptable to the AA and AA Business Customers. Please contact the AA immediately if you are unhappy in any way with a referral made by the AA to an independent contractor and the AA will endeavour to correct your dissatisfaction and/or offer you the choice of an alternative provider.
The AA endeavours to provide the full range of benefits and services outlined in this brochure in good faith. However, it cannot be held responsible for consequential loss or damage resulting from acts, events and circumstances beyond the reasonable control of the AA, including industrial disputes, strikes, flood conditions, adverse weather conditions, geographic inaccessibility and the absence or unavailability of sub-contractors which may delay, interfere with, or prevent, the provision of some or all of the services outlined in this brochure.
Business information relating to AA Mobility Care is held securely and will not be disclosed to any other person or organisation unless authorised by you. AA Mobility Care customers also have the right to access and correct the information at any time.
The information provided by the Business may be used by the AA for administrative purposes and for the purpose of providing the Business with information relating to products and services from time to time. For this purpose the New Zealand Automobile Association (AA) includes itself/any division, subsidiary, third party under contract, or joint venture companies including but not limited to AA Financial Services and AA Insurance.
